LETTER OFFERS GUIDANCE ON STUDENT DATA PRIVACY ACT

The Student Data Privacy Act has created tremendous concern for schools and their leaders. While the can was "kicked down the road" for one year during the last legislative session, there is much to be done prior to implementation of the statute. Reportedly, there will be a reconvening of the task force to take another look at the language and requirements for schools. In the meanwhile, this letter, which was developed in partnership with Doug Casey, the executive director of the Commission for Educational Technology, offers helpful information.

RESOURCES AVAILABLE TO ASSIST SCHOOLS IN ASSIMILATING STUDENTS DISPLACED BY HURRICANES

Last week, Governor Dannel Malloy and Commissioner Dianna Wentzell issued a memo advising districts to revisit their protocols aligned with the federal McKinney-Vento Homeless Assistance Act to ensure that any student arriving from Puerto Rico or any affected storm area has immediate access to school and expedited connections to the services they may need. The memo was accompanied by resources to help school personnel understand their responsibilities under McKinney-Vento and help them provide stability and support for students who have been uprooted by the recent disasters. The resources can be downloaded from Governor Malloy’s website at http://casci.ac/2582.

Additionally, the CIAC has issued a memo specific to questions regarding the eligibility of displaced students to participate in CIAC sponsored interscholastic sports.

LEGAL MAILBAG

The Legal Mailbag column is written by Attorney Thomas Mooney of the University of Connecticut's Neag School of Education. Readers are invited to submit short, law-related questions of practical concern to school administrators. One question and its answer will be published in this column each week. Questions may be edited; authors will not be identified; and answers cannot be considered formal legal advice. Please submit questions to: legalmailbag@casciac.org

Dear Legal Mailbag:
It is bad enough that I can’t kick back and watch a Sunday night matchup without being confronted with political protests. Now, as the assistant principal in a high school, I am getting panicky emails from teachers and coaches asking me what to do if the students in their charge “take a knee” during the recitation of the Pledge of Allegiance or the playing of the National Anthem. I know what I would like to say, but I don’t want to get sued for giving bad advice.
